Notice of Privacy Practices

Wellstart is dedicated to maintaining the privacy of your healthcare information, and the Company adheres to laws that maintain the confidentiality of information that identifies you, specifically stated within the Health Insurance Portability and Accountability Act. This Notice of Privacy Practices describes how Wellstart may use and disclose your protected health information to carry out treatment, payment, or health care operations and for other purposes that are permitted or required by law. It also describes your rights to access and control your protected health information. Protected health information is information about you, including demographic information that may identify you and that relates to your past, present, or future physical or mental health condition and related health care services. Wellstart is required to abide by the terms of this Notice of Privacy Practices. Wellstart reserves the right to change the terms of the notice, at any time. Any new notice will be effective for all protected health information that the Company maintains at that time. Although your health record is the physical property of the healthcare organization that compiled it, the information belongs to you. You have the right to:

• Request a restriction on certain uses and disclosures of your information;
• Obtain a copy of the Notice of Privacy Practices upon request;
• Amend your health record;
• Obtain an accounting of disclosures of your health information;
• Request communications of your health information by alternative means or at alternative locations;
• Revoke your authorization to use or disclose health information except to the extent that action has already been taken

Wellstart is required to:

• Maintain the privacy of your health information;
• Provide you with a notice to our legal duties and privacy practices with respect to information we collect and maintain about you;
• Abide by the terms of this notice;
• Notify you if we are unable to agree to a requested restriction;
• Accommodate reasonable requests you may have to communicate health information by alternative means.

Wellstart will not use or disclose your health information without your authorization, except as described in this notice. If you believe your privacy rights have been violated, you can file a complaint with Wellstart’s Privacy Officer or with the Secretary of Health and Human Services. Protected health information obtained by Wellstart will be recorded in your record and used to provide you with necessary medical supplies. Wellstart will also use your health information for payment and reimbursement. A bill may be sent to you or a third-party payer and the information on or accompanying the bill may include information that identifies you, as well as your diagnosis and supplies used. Wellstart will also use your health information for regular healthcare operations. Teammates of Wellstart’s quality improvement team may use information in your health record to assess the Company’s compliance with applicable law, regulation and industry standards. This information will then be used in an effort to continually improve the quality and effectiveness of the service Wellstart provides.

Wellstart may use and disclose your protected health information without your verbal or written authorization as follows:

• Business Associates: There are some individuals who are under contract with Wellstart and, from time-to-time, are engaged in the improvement or financial enhancement of the Company. Wellstart requires any business associate to appropriately safeguard your information so that your health information is protected.

• Public Health Officials: As required by the law, Wellstart may disclose your health information to the public health or legal authorities charged with preventing or controlling disease, injury, or disability.

• Law Enforcement: Wellstart may disclose health information for law enforcement purposes as required by federal, state, or local law or in response to valid subpoena.

• Health Oversight Agencies: Wellstart may disclose health information to health oversight agencies for activities authorized by law, including surveys, audits, and compliance inspections.
